01 Who We Are & Scope

This Privacy Policy explains how Systemly (ABN 41 165 831 752), a sole trader based in Perth, Western Australia ("Systemly", "we", "us" or "our"), collects, uses, holds and discloses your personal information.

We are committed to protecting your privacy and handling your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), the Spam Act 2003 (Cth), and other applicable Australian laws. This Policy applies to our website at systemly.com.au and to the services we provide to our clients.

02 Information We Collect

The types of personal information we may collect include:

  • Contact & identity details — your name, business name, email address, phone number and postal or business address.
  • Business information — details about your business, industry, goals and the services you enquire about or purchase.
  • Billing information — information needed to invoice you. Card payments are processed by third-party payment providers; we do not store full card numbers.
  • Communications — records of your enquiries, correspondence and feedback.
  • Technical & usage data — IP address, browser type, device information, pages visited and similar analytics collected automatically when you use our website (see Cookies below).
Data we handle on behalf of clients. When we build and operate websites, CRMs, automations and lead-capture systems for our clients, those systems may collect personal information about the client's own customers. In relation to that data we act as a service provider on the client's behalf; the client is the entity responsible for that information and for its own privacy obligations to those customers.

03 How We Collect It

We collect personal information in a number of ways, including:

  • directly from you when you contact us, book a call, request a quote, sign up for our services or correspond with us;
  • automatically through cookies and analytics tools when you visit our website;
  • from third parties such as our booking platform, payment processors and analytics providers; and
  • from publicly available sources where relevant to providing our services.

Where it is reasonable and practicable, we will collect personal information directly from you.

04 Why We Use Your Information

We use personal information to:

  • provide, manage and improve our services and respond to your enquiries;
  • prepare proposals and quotes, set up and maintain your systems, and provide support;
  • process payments and send invoices;
  • communicate with you about your account, our services and service-related notices;
  • send you marketing or promotional material where you have consented or where otherwise permitted by law (you can opt out at any time); and
  • comply with our legal obligations and protect our legal rights.

05 Disclosure to Third Parties

We do not sell your personal information. We may disclose it to trusted third parties who help us deliver our services, including:

  • website hosting, infrastructure and domain providers;
  • CRM, email and SMS automation platforms;
  • booking, calendar and scheduling tools;
  • analytics and advertising providers;
  • payment processors and accounting software; and
  • professional advisers, or where required or authorised by law.

We only share what is reasonably necessary, and we take reasonable steps to ensure these providers handle your information appropriately.

06 Overseas Disclosure

Some of the third-party providers we use store or process data on servers located outside Australia (for example, in the United States or the European Union). Where we disclose personal information to overseas recipients, we take reasonable steps to ensure it is handled consistently with the Australian Privacy Principles. By using our services, you acknowledge that your information may be stored or processed overseas.

07 Cookies & Analytics

Our website uses cookies and similar technologies to operate properly, remember your preferences and understand how the site is used. Analytics tools may collect aggregated, de-identified information about visitor behaviour.

You can disable cookies through your browser settings, although some parts of the website may not function as intended if you do.

08 Direct Marketing & Opt-Out

We may send you marketing communications where you have consented or where it is otherwise permitted under the Spam Act 2003 (Cth). Every marketing email includes an unsubscribe option, and you can opt out at any time by contacting us at hello@systemly.com.au. We will action your request promptly.

09 Data Security

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. However, no method of transmission or storage over the internet is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any account credentials we provide confidential.

10 Data Retention

We retain personal information only for as long as is necessary to provide our services, to meet our legal, tax and accounting obligations, and to resolve disputes. When information is no longer required, we will take reasonable steps to destroy or de-identify it.

11 Access & Correction

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. To make a request, email us at hello@systemly.com.au. We will respond within a reasonable time and may need to verify your identity first. In limited circumstances we may decline a request as permitted by law, and we will tell you why.

12 Complaints

If you believe we have breached the Australian Privacy Principles or mishandled your personal information, please contact us first at hello@systemly.com.au so we can investigate and respond. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

13 Third-Party Links

Our website and systems may contain links to third-party websites and services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy policies before providing them with personal information.

14 Children's Privacy

Our services are directed at businesses and are not intended for children. We do not knowingly collect personal information from children under 16. If you believe we have inadvertently done so, please contact us and we will delete it.

15 Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The current version will always be available on this page, with the "Last updated" date shown above. Continued use of our website or services after any change indicates your acceptance of the updated Policy.
